However, we do not warrant that product descriptions, images, pricing, or other content is accurate, complete, reliable, current, or error-free. Colors and textures of food items may vary from images due to natural variations in ingredients and preparation methods.
5.2 Food Safety and Allergen Information
We follow all applicable food safety regulations and maintain high standards of hygiene in our kitchen. However, please note:
- Our kitchen handles common allergens including wheat, dairy, eggs, nuts, soy, and seafood

5.3 Pricing and Payment

Delivery services are subject to the following terms:
- Delivery is available within designated zones and during specified hours
- Minimum order requirements may apply for delivery
- Delivery times are estimates and may vary due to weather, traffic, or high demand
- Temperature-sensitive items should be consumed promptly upon delivery
- Delivery personnel will make reasonable attempts to deliver to the specified address
- You must be available to receive delivery at the specified time and location
5.6 Food Quality Guarantee
We take pride in the quality of our food and service. If you are unsatisfied with your order, please contact us within 24 hours of purchase. We will work to resolve any quality issues through replacement, credit, or refund as appropriate.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) SHALL NOT EXCEED THE AMOUNT OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID TO US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
The foregoing limitation will apply whether such damages arise out of breach of contract, tort (including negligence), or otherwise and regardless of whether such damages were foreseeable or we were advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations may not apply to you. To the extent that we may not, as a matter of applicable law, disclaim any warranty or limit our liability, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.

You agree to defend, indemnify, and hold harmless Pizza luce, its affiliates, agents, directors, employees, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

These Terms shall be interpreted and governed by the laws of the State of California, United States, without regard to conflict of law provisions. You agree that any legal action or proceeding between you and Pizza luce for any purpose concerning these Terms or the Service shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Napa County, California.
Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred.
In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement through good faith negotiations.
If such negotiations do not result in a mutually satisfactory resolution within thirty (30) days, either party may pursue resolution through the appropriate courts as specified above.
You and Pizza luce agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion. Changes may be communicated through:

15.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.
15.5 Force Majeure
We will not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.
15.6 Headings
The headings and subheadings in these Terms are for convenience only and have no legal or contractual effect.
